Terms of use

1. Acceptance of terms

Everywhere’s Local's personals (Sex, Love & Friendships) contains personal ads provided by our visitors to the website, wherein all information here is user-entered ("services"). By using our services you hereby agree to our terms of use ("terms"). These terms may be changed at any time, and at our discretion. You must agree to the terms before registering or searching our site; as well as understand them before using our site.

2. Content

All images, messages, personal ads, or other material (“content”) on Everywhere’s Local's Sex, Love and Friendship is entered by visitors to our site. You realize that all material posted is the sole responsibility to those who posted it, and that we do not monitor or maintain any information (except where we check personal ads for illegal or related content), nor are we responsible for any content, linked content, or other information that’s posted to our site. We make no warranty or claim to the validity of any items posted on our site, nor any information linked to or from our or other sites. You understand that any and all information that you post to our site is solely your responsibility, and that all information that's linked ("3rd party content") is the responsibility of those sites as based on their terms, and is in no way related to us.

3. Rights Infringement

If your copyright or other information is violated, or you believe it to be violated, contact us at abuse@everywhereslocal.com or write us at:

Be sure to include the personal handle, id (if available), and as much information as possible. Copy and/or print the post out. Also include:
a. statement by you that the content’s use isn’t authorized by the copyright owner
b. A statement by you declaring under penalty of perjury that (a) the above information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner
c. Your physical address, telephone number, and e-mail address
d. Physical or electronic signature
We do take these issues seriously; however, we do need proof that you do own the rights, and the other doesn’t.

4. Privacy and Information Disclosure

Any information that you post to our site will be visible to others; however, the items that will be visible are obvious (personal ad content viewable to all, and e-mails sent to memebers will be visible to that person). No information will be leased, sold, auctioned, given, or otherwise handed over to other parties without a warrant or written consent or as otherwise required by law. Any information that you tell to put on the website can be visible to everyone who visits the site.

5. Age Restrictions / Adult Content

Everywhere's Local's Sex, Love & Friendship does not allow any pornographic or other adult material, nor do we allow obscene language to be used publically. All content should be PG-13 type of ratings. However, since it is a "dating website" as defined by organizations, we're considered an "adult website" despite the lack of actual adult content.

The following guidelines are setup for using and accessing our site:

• NO minors. No exceptions. If you're not 18, or the legal age in your area to view adult material, you are not allowed to view or use this site.
• All people must give us their full name, and birthdate before accessing the site. In addition, this information will be stored in your profile as well as your ip address.
• Your name and birthdate you provide us will be used for the name of any credit cards, checks, etc that you may use to pay us for a paid membership. WE WILL NOT ACCEPT CARDS/CHECKS UNDER OTHER NAMES!
• If your name changes during the use of our site, you must contact us to update the information. We may request proof of name change, or otherwise proof of your age to be determined at that time.

Even though you will find no nudity publically available, nor any obscene language in public parts of our site you must consider this site to be an "adult" site. If you are a parent, we recommend you install child-website-protection software on your computer. Our site is listed as containing content which we forbid so that children should not be able to access the site with software installed.

Personal e-mails are excluded from any obscene language or picture nudity. We won't monitor them for so your communications are "private" so much as you and your communication party don't post the information; however we reserve the right to check or turn them over to police agencies should the need arise. This includes if we discover a large amount of pictures being sent. If we discover child pornography or other such content that's illegal being sent over our system; any such content will imediately be turned over to the FBI or other government agency. Your account will be locked, and all ip addresses and other information we have on you will be turned over on request by that agency. We will not tolerate any use of our systems, or abuse of another person. You will also receive no warning to this happening prior to your account being locked.

6. Conduct

By using the site you agree not to post, use or make available any content:

• that is harmful, threatening, damaging, libelous, invasive of another's privacy, or harmful to minors in any way
• that is Pornographic in nature, whereas genitals are visible, sexual acts are transpiring or implied, sexual intercourse with a human or non-human, or any content wherein the sole purpose is to arouse or create a sexual atmosphere.
  • lingerie, or otherwise "all day acceptable" network shows in the United States are acceptable in most cases
• that Harasses or degrades an individual based on age, gender, race, creed, religion, disability, sexual orientation, or anything else including but not limited to hair color.
• that impersonates another person or entity, including but not limited to Everywhere’s Local personnel, or implies that you are affiliated with a person or entity that you are not
• that uses a scam, con, MLM, phishing, spam, pyramid scheme, bait-and-switch, or other similar illegal content
• that infringes on any copyright, trademark, trade secret, proprietary rights of a party
• that contains a affiliate code, affiliate link, or other commercial income generating material; except where such content was approved by means of an advertising banner
• that contains a virus, worm, adware, or other computer software item that can slow, damage, or destroy: data, software, hardware, electronic equipment, or any other item it may come across
• that advertises any item that’s illegal for sale in your state or the state of Illinois, or the state of California, or in the country, or in the country, or in the world where you reside.
• that advertises for sale, rent, lease, free, auction, or other method of transfer any human body part, alcohol (without proper age verification methods, given that it is otherwise legal), children, foods, explosives, or other potentially hazardous material; including, but not limited to, any items that cannot be shipped through normal means (exceptions being a business service, ex: hospital, catering services, etc)
• that intentionally forges headers or contains misleading information to misguide or hide the true individual behind the content
• that violates the FAIR HOUSING laws of the United States (if the post is in the United States), and of the location where the real-estate item is listed. Likewise does not violate any housing laws of the country which the real-estate item is listed.

7. Disclaimer of Warranties

YOU AGREE THAT USE OF EVERYWHERE’S LOCAL'S SEX, LOVE AND FRIENDSHIP SITE AND THE SERVICE IS ENTIRELY AT YOUR OWN RISK. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. In some jurisdiction, limitations of liability are not permitted. 9. Indemnity

You agree to indemnify and hold Everywhere’s Local's Sex, Love and Friendship, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of Content you submit, post or make available through the Service, your use of the Service, your violation of the Terms, your breach of any of the representations and warranties herein, or your violation of any rights of another.
